The Supreme Court could rule that it is unconstitutional for individual states to allow wineries in-state to ship but to bar out-of-state wineries to ship in. With a ruling like that, states could simply ban all shipping instead of opening it up to out-of-state wineries--and with the court's bent for state's rights it is a likely outcome.
